(Relating to the use of the KLSpeaks, LLC website and any services offered/provided) Please read the following before booking services with KLSpeaks, LLC. By booking, you accept that you are entering into a contract with us based on these Terms and Conditions.
We reserve the right to make any necessary changes to these Terms and Conditions. Important: Please ensure that you inform us of any change of details (e.g. your email address). This will ensure that we are able to continue to contact and provide you with the services you have requested.
TERMINATION OF SERVICES FOR NON-COMPLIANCE
If you do not comply with the terms and conditions at any time we reserve the right to terminate your access to the Site and Services. We may discontinue or alter any aspect of the Site or the Services, including, but not limited to changing the time the Site or the Services are available, changing the amount of use permitted, and changing or terminating your right to use the Site or the Services, at our sole discretion and without prior notice or liability.
AUTHORIZED USERS
The terms “you,” “your” or “User(s)” refers to any individual accessing the Site or the Services for his/her own personal purposes, or on behalf of an entity or other person.
For the purposes of these Terms and Conditions, “you” also means a parent or guardian or a person who allows a child to use this site who pays for access to the Site and Services as well as the student who accesses the Site or uses the Services.
PAYMENTS
You are solely responsible for maintaining the confidentiality of your account, username and password and for all activities and liabilities associated with or occurring under your account, username and password. You must notify us immediately of any unauthorized use of your account, username or password and any other breach of security, KLSpeaks LLC, does not take responsibility for any loss or damage arising from your failure to comply with this requirement or as a result of use of your account, username or password, either with or without your knowledge. However, you could be held liable for losses incurred by us or another party due to someone else using your account, username or password.
Client will pay during check-out at the pay portal according to services booked online before services are rendered. All Speaking Engagements booked will have a separate payment schedule and the price will vary by Event.
Parent Support Services/Video and Webinar trainings are $99 and charged before services are rendered. ALL services provided by KLSpeaks, LLC are intended for informational purposes ONLY.
$99 per hour when booking for (Middle/High School/College/ ACT PREP) single session
$124 will be charged weekly each session when booking Kelvin’s Academic CoachingServices (1 single session) or $497 for the Monthly Academic Coaching Package. First time guarantee.
Payments and purchases may not be canceled by the user, except as required by law. KLSpeaks, LLC reserves the right to refuse or terminate any purchase or attempted purchase at any time in its sole discretion. You understand and agree that if you authorize a payment transaction with your credit card, debit card, or other payment method, but your charge is rejected for any reason, there may be a hold on your use of that transaction amount for several days.
CANCELLATIONS/GUARANTEES
KLSpeaks, LLC offers the client 100% guaranteed services. If for any reason you are not pleased with services or it turns out that the student and academic coach are not a good fit then KLSpeaks, LLC will refund your money within (7) days of notification after initial session. Client must send in writing their complaint or dissatisfaction with services immediately so administrator can consult with client at contact@klspeaks.com. We are committed to student success and with the right amount of effort and focus by the student we can help you achieve your academic goals. KLSpeaks does not accept any responsibilty for students performance. Our tutors will give 100% of their time, dedication, and effort towards your success .
100% charge for less than 24hour notice of cancellation of sessions. (short term cancellation) In the case of illness or other extenuating circumstances exceptions can be made on a case by case basis. Contact the administrator in writing with advance notice at contact@klspeaks.com.
SERVICES
We provide Services that allows students to connect with tutors and instructors (“Tutors”) who provide live, one-to-one or groupTutoring and Academic Coaching services. You are solely responsible for providing, maintaining and ensuring the compatibility of all hardware, software, electrical and other physical requirements necessary for your access to and use of the Site. Our tutors will give 100% of their time, dedication, and effort towards your success.
RECORDING
You agree that we may record all or any part of any of our online Tutoring , Academic Coaching Services, Webinar Trainings, or videos. We reserve the right to use the recorded sessions for any purpose allowed by our Privacy Policy. You agree that we own all transcripts and recordings of Tutoring and Academic Coaching and all comments that you may provide to us on or through the Site or Services.
AVAILABILITY OF SERVICES
Services will periodically be unavailable during some Holidays, Vacations, or site maintenance. When students have a break from school, Christmas Holidays, etc. KLSpeaks, LLC schedule may change or pause as a default. The specifics will be discussed as the time approaches.
NO REPRODUCTION/DISTRIBUTION
The reproduction, duplication, distribution (including by way of e-mail, facsimile or other electronic means), publication, modification, copying or transmission of material available on or through this Site or the Services is STRICTLY PROHIBITED without the prior written consent of KLSpeaks, LLC or unless expressly permitted by this Site or the Services. This includes, without limitation, any application, text, graphics, logos, photographs, audio or video material or stills from audiovisual material available on this Site by KLSpeaks, LLC. The copying posting, linking, or other use of Content from this Site or the Services on any other website or networked computer environment prohibited. Requests for permission to reproduce or distribute materials found on this Site or the Service can be made by contacting KLSpeaks, LLC in writing at contact@klspeaks.com
ARBITRATION
ALL PARTIES TO THESE TERMS AND CONDITIONS WAIVE THEIR RESPECTIVE RIGHTS TO A TRIAL BY JURY. The exclusive means of resolving any dispute or claim arising out of or relating to these Terms and Conditions (including any alleged breach thereof) or the Site shall be BINDING ARBITRATION.
The arbitration proceeding shall be kept confidential by the parties, their representatives and the arbitrator, subject to the right of any party to enforce the arbitral award. Each party shall bear its own costs and expenses and an equal share of the arbitrator’s and administrative fees of arbitration. By using the Site, you agree to the above Arbitration Agreement.
COMMUNICATION
If you provide us your e-mail address, you agree and consent to receive e-mail messages from us. These e-mails may be transactional or relationship communications relating to the services we offer, such as administrative notices and service announcements or changes, or e-mails containing commercial offers, promotions or special offers from us. You may also book services and therefore agree to receive SMS or text messages on your mobile phone.
I declare that I have read, understand, and agree with the above Terms and Conditions. By booking with KLSpeaks, LLC I understand I am bound to these Terms and Conditions.
